In my opinion for Kashif Ltd. an agency is the most relevant form of bussiness activity in Irish Republic. The information that we have about Kashif Ltd and about its activity in mainland GB are not suffiecient to confirm its unambiguously. It depends on its activity till present, because we know that limited company has to have a specific structures. It is possible that the strutctures of Kashif Ltd (i.e. accountancy ) can be not prepared to run different kinds of bussiness activities and it will take a time to accommodate them to do it. I will consider it in the next answer. As a conclusion of my expression I do not exclude other marketing arragements to use in Kashif’s Ltd situation. The distribution agreement and licensing agreement can be used to launch Kashif Ltd to new markets as well as agency, but I think that franchising can turn over the most suitable form to run bussiness in Irish Republic.
In the next answer I would like to consider what kind of activity will be the best for the company in Irish Republic, but now I have to make a sugestion about Kashif Ltd’s decision to leave Northen Ireland trade at hands of Scottish ‘contact’.
At this point I have to express that Scotland has a specific law which is slighty different from English law. I suppose that in Northen Ireland there is a similar situation, especially in administrative law (which is very important to bussiness). The Scottish ‘contact’ (an agent I suppose) can be well-versed in Scots Law and local trade, but its legal knowledge can turn over not enough to deal with Northern Ireland. My sugestion is to leave to it the trade in Scotland as a sole agent in Scotland, and to find a sole agent to deal with Northern Ireland. This solution will make their job more secure and more effective, than to leave trades in two countries with different regulations at hands of one ‘contact’ (even if those regulations are similar).
